These Terms of Use (hereinafter the "Terms") set forth the rights, obligations, responsibilities, and other matters concerning the use of the object.tex website (https://www.object-tex.com), mobile application, and related global services (hereinafter collectively the "Service") provided by Object Company (hereinafter the "Company"), between the Company and its global users (hereinafter "User(s)").
By accessing or using the Service, the User is deemed to have agreed to these Terms and the separately provided [Privacy Policy]. If the User does not agree to these Terms, the User must immediately discontinue use of the Service.
Article 2 (Definitions)The definitions of terms used in these Terms are as follows.
"Platform" means the website, mobile application, and other digital environments operated by the Company to provide goods, services, or digital content (hereinafter "Goods, etc.") to global Users.
"User" means a Member or non-member who accesses the Platform and uses the services provided by the Company in accordance with these Terms.
"Member" means a person who provides information to the Company, creates an account, and continuously uses the Service.
"User Content" means all materials, including text, images, reviews, questions, and media, that a User posts, uploads, or transmits within the Platform.
Article 3 (Amendment and Notification of the Terms)
The Company may amend these Terms from time to time to the extent that it does not violate applicable laws and regulations.
When amending the Terms, the Company shall specify the effective date and the reasons for the amendment and shall notify Users through a notice on the Platform or via the User's registered email address at least 7 days before the effective date of the amended Terms (at least 30 days in advance for material changes that are disadvantageous to Users).
If a User continues to use the Service after the effective date of the amended Terms, the User is deemed to have agreed to the amended Terms.
Article 4 (Eligibility to Join and Global Age Restrictions)
To use the Service, a User must have reached the minimum age required under the laws of the User's country of residence to consent to the use of digital services (for example, 13 years of age or older in the United States, 16 years of age or older in the European Union, etc.).
A User under such minimum age may only create an account and use the Service if the explicit and valid consent of a parent or legal guardian has been confirmed in accordance with the laws of the User's place of residence.
Users must provide accurate and up-to-date information when creating an account. Use of the Service may be restricted, or an account may be deleted immediately, if a User steals another person's information or registers false information.
Article 5 (Account Management and Security)
A Member is responsible for managing their own account access information (ID and password) and may not lend, transfer, or sell their account to any third party.
If a Member becomes aware that their account information has been leaked or is being used without authorization by a third party, the Member must immediately notify the Company and follow the Company's instructions. Unless the Company is guilty of intent or gross negligence, the Company shall not be liable for damages arising from a Member's failure to properly manage their account.
Article 6 (Orders, Payment, and Fees)
A User applies to purchase Goods, etc. in accordance with the procedures provided by the Platform, and the Company shall provide a confirmation notice through which the User can verify the order details and payment amount.
Payment shall be made through the global payment methods accepted by the Company (credit card, PayPal, Apple Pay, Google Pay, and other electronic payment methods, etc.).
Any foreign exchange rate fluctuations, international payment fees, and fees charged by the issuing card company arising in the course of processing an order shall be borne by the User.
Article 7 (International Shipping, Customs Clearance, and Duties and Taxes)
The Company provides international shipping services to the delivery address designated by the User. The delivery period may vary depending on the destination country, import customs clearance procedures, logistics conditions, and other factors.
[Responsibility for Customs Duties and Clearance] Any customs duties, import value-added tax/goods and services tax (VAT/GST), customs clearance fees, and other taxes arising from the importation of any product into the destination country shall be borne entirely by the recipient (User).
If a product is returned or discarded due to the User's refusal of customs clearance, non-payment of duties, an unclear address, or similar reasons attributable to the User, the Company shall not be liable for any refund, and the Company may charge the User for any return shipping costs incurred.
The Company shall not be liable for any delivery delay caused during shipping by an act of God, customs clearance delay, import restrictions, or other causes beyond the Company's reasonable control.
Article 8 (Regional Right of Withdrawal, Exchange, and Refund)
[Residents of the European Union (EU) and the United Kingdom] Users residing in these regions may exercise their Right of Withdrawal within 14 days from the date of actual receipt of the goods, for any reason, in accordance with applicable consumer protection regulations.
[Users in Other Regions] For Users outside the EU and the United Kingdom, cancellation of an order and refunds after payment has been completed shall be governed by the Company's separate [Refund and Exchange Policy]. However, where mandatory consumer protection laws of the relevant country exist, such laws shall prevail.
[Items Subject to Return Restrictions] Returns and refunds may be restricted in any of the following cases:
Where the product has been lost or damaged due to a cause attributable to the User
Where the value of the product has significantly decreased because the packaging has been opened, or where resale is not possible for hygiene reasons
Customized/personalized goods that are individually produced according to the User's order
Digital content for which downloading or streaming has already begun (where prior consent has been obtained)
In the case of a return due to a simple change of mind, the User shall bear the international return shipping costs and customs clearance costs. However, in the case of a defective product or an incorrect shipment, the Company shall bear the return shipping costs.
Article 9 (Intellectual Property Rights and User Content)
All intellectual property rights in the Service, website design, trademarks, source code, text, images, and the like provided by the Company belong to the Company.
The copyright in User Content, such as reviews and images created by a User, belongs to the author. However, by posting Content, the User grants the Company a non-exclusive, royalty-free, worldwide license to reproduce, modify, translate, display, and distribute such Content for the purposes of operating, improving, and promoting the Service.
A User may not reproduce, distribute, or publish, for commercial purposes, any intellectual property obtained through the Service without the Company's prior consent.
Article 10 (Prohibited Conduct)A User shall not engage in any of the following acts when using the Service:
Unauthorized use of another person's identity, payment information, or personal information
Causing harm to the Company's platform or servers, or unauthorized modification, reverse engineering, or hacking of the system
Infringing the intellectual property rights, privacy, reputation, or other rights of others, or posting illegal, obscene, or violent content
Using automated programs (bots, scrapers, etc.) to collect information without authorization or to place an undue burden on the system
Using abusive language, profanity, sexual harassment, or exercising undue pressure against the Company's customer service staff
Interfering with the Company's normal business operations, such as through abnormal repeated payments/cancellations or exploiting system errors
Article 11 (Modification and Suspension of the Service)The Company may modify or temporarily suspend all or part of the Service after prior notice (or subsequent notice in an emergency) where necessary due to maintenance, inspection, or replacement of equipment, network failure, response to hacking, an act of God, or other operational necessity.
Article 12 (Disclaimer of Warranties)
To the maximum extent permitted by law, the Service and all Goods are provided "AS IS" and "AS AVAILABLE."
The Company makes no warranty of any kind, whether express or implied, as to the error-free operation, continuity, fitness for a particular purpose, merchantability, or non-infringement of the Service.
Article 13 (Limitation of Liability)To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages (including loss of profits, loss of data, or business interruption) arising from a User's use of, or inability to use, the Service, regardless of whether the Company was advised of the possibility of such damages in advance.
Article 14 (Indemnification)A User agrees to defend, indemnify, and hold the Company harmless from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of the User's breach of these Terms, violation of applicable law, infringement of any third party's rights, or User Content.
Article 15 (Protection of Personal Information)The Company complies with global data protection regulations, including the EU GDPR and the U.S. CCPA, and safeguards Users' personal information. Specific matters concerning the collection, use, storage, cross-border transfer, and destruction of personal information shall be governed by the Company's [Privacy Policy].
Article 16 (Governing Law, Jurisdiction, and Binding Individual Arbitration)
Governing Law: These Terms and any dispute between the Company and a User shall be governed by the laws of the Republic of Korea, provided that this shall not deprive the User of the protection afforded by any mandatory consumer protection provisions of the User's country of residence.
Binding Individual Arbitration: Any and all disputes arising between the Company and a User in connection with these Terms or use of the Service shall be finally resolved through binding individual arbitration instead of litigation.
Class Action Waiver: The User and the Company agree that any claims may be brought only in an individual capacity, and neither party will participate in any class action, representative action, or consolidated proceeding as a plaintiff or class member.
